General terms and conditions of sale – ARKOS DECOR

ARTICLE 1 – GENERAL PROVISIONS
These General Terms and Conditions of Sale (GTCS) govern sales made under the brand ARKOS DECOR by SARMIS, a single-member limited liability company under French law with a capital of €8,500, SIRET 80955549300034, EU VAT FR85809555493, whose registered office is at 17 rue de Sancey, 89100 Sens, France. ARTICLE 2 – PRODUCTS
The products offered are architectural decorative elements. Photographs and descriptions are as accurate as possible but are not contractually binding.

ARTICLE 3 – ORDER AND PAYMENT
The sale is final after confirmation by e-mail and full payment of the price. Trade customers: a dedicated area allows businesses established outside France to be invoiced exclusive of VAT, subject to a valid EU VAT number. French businesses are invoiced inclusive of VAT.

ARTICLE 4 – PRICES, CURRENCIES AND TAXES
Prices are shown in the local currency of the country viewed (euro, Swedish krona, etc.), inclusive of all taxes for consumers. The VAT applied is that of the country of delivery for consumers in the European Union (OSS scheme). Transport costs are calculated at payment.

ARTICLE 5 – DELIVERY AND RECEIPT
5.1. Dispatch: preparation and dispatch within 2 to 4 working days after order confirmation. 5.2. Breakage claims: any damage must be precisely noted on the delivery note in front of the carrier. 5.3. Proof: any claim must be reported within 48 hours by e-mail with mandatory photographs of the packaging and the damaged product. Failing this, the seller reserves the right to refuse the claim.

ARTICLE 6 – RIGHT OF WITHDRAWAL AND RETURNS
The consumer customer has 14 days from receipt to withdraw.

• The customer arranges and pays for the return.
• The return address is provided on request.
• The product must be returned in its original packaging and free of any defect. The refund is made after technical approval by our warehouse, at the latest 14 days later.

ARTICLE 7 – RETENTION OF TITLE
The seller retains ownership of the products until full payment of the price.

ARTICLE 8 – LIABILITY AND WARRANTY
8.1. Mandatory condition: any defect must be reported BEFORE fitting the product. No fitted, glued or painted product can be exchanged or refunded. 8.2. Exclusions: the warranty does not cover defects linked to poor installation, inappropriate maintenance or any modification, cutting or machining of the product by the customer. 8.3. The legal warranties of conformity and against hidden defects apply under the conditions provided by law.

ARTICLE 9 – APPLICABLE LAW
These GTCS are governed by French law. Any dispute shall be brought before the competent courts of Sens, without prejudice to the mandatory consumer protection provisions in the consumer’s country of residence. Consumers may use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr.
